พรบ. คุ้มครองข้อมูลส่วนบุคคล(PDPA) เลื่อนการบังคับใช้ 1 ปี มีผลอะไรบ้าง และต้องปรับตัวอย่างไรให้สอดคล้องกับกฎหมาย

ครม.มีมติเห็นชอบออกพระราชกฤษฎีกา แต่งตั้งกฎหมายคุ้มครองข้อมูลส่วนบุคคลแล้ว และขยายระยะเวลาการบังคับใช้ออกไปอีก 1 ปี (บางหมวด)

บทบัญญัติที่ ครม. มีมติให้ขยายเวลาบังคับใช้

• หมวด 2 การคุ้มครองข้อมูล ส่วนบุคคล
• หมวด 3 สิทธิของเจ้าของข้อมูลส่วนบุคคล
• หมวด 5 การร้องเรียน
• หมวด 6 ความรับผิดทางแพ่ง
• หมวด 7 บทกำหนดโทษ
• มาตรา 95 ของบทเฉพาะกาล ซึ่งเป็นเรื่องของการเก็บรวบรวมและใช้ข้อมูลเดิม

หน่วยงาน, องกรณ์ และธุรกิจที่ถูกเลื่อนให้ใช้ พรบ.นี้ในปีหน้า

19 ธุรกิจนั้น ได้แก่

1. กิจการด้านเกษตรกรรม
2. กิจการด้านอุตสาหกรรม
3. กิจการด้านพาณิชยกรรม
4. กิจการด้านการแพทย์และสาธารณสุข
5. กิจการด้านพลังงานไอน้ำ น้ำ และการกำจัดของเสีย รวมทั้งกิจการที่เกี่ยวข้อง
6. กิจการด้านการก่อสร้าง
7. กิจการด้านการซ่อมและบำรุงรักษา
8. กิจการด้านการคมนาคม ขนส่ง และการเก็บสินค้า
9. กิจการด้านการท่องเที่ยว
10. กิจการด้านการสื่อสาร โทรคมนาคม คอมพิวเตอร์ และดิจิทัล
11. กิจการด้านการเงิน การธนาคาร และการประกันภัย
12. กิจการด้านอสังหาริมทรัพย์
13. กิจการด้านการประกอบวิชาชีพ
14. กิจการด้านการบริหารและบริการสนับสนุน
15. กิจการด้านวิทยาศาสตร์และเทคโนโลยี วิชาการ สังคมสงเคราะห์ และศิลปะ

เนื่องจากสถานการณ์ COVID-19 ทำให้ธุรกิจต่างๆทุกขนาดเกิดปัญหาการดำเนินงาน รวมถึงสภาวะการเงินที่จำเป็นต้องใช้เพื่อฟื้นฟูธุรกิจ การบังคับใช้กฎหมายในช่วงเวลานี้ อาจทำให้เกิดการฝ่าฝืนกฏหมายโดยไม่ได้ตั้งใจ และอาจเป็นช่องทางให้เกิดการแสวงหาผลประโยชน์หรือทุจริตโดยมิชอบ รวมถึงเป็นอุปสรรคในการอบรมบุคลากรกับกฎหมายดังกล่าว จึงมองว่าการเลื่อนจะทำให้หลายภาคส่วนสามารถเตรียมความพร้อมได้
