เริ่มต้นบังคับใช้แล้ว พรบ.คุ้มครองข้อมูลส่วนบุคคล (PDPA)

เมื่อ วันที่ 1 มิถุนายน 2565 ที่ผ่านมา

หลังจากมีการเลื่อนบังคับใช้ พรบ.คุ้มครองข้อมูลส่วนบุคคลอีกครั้ง จากปี 2564 ที่ผ่านมา ในปีนี้ กฎหมายดังกล่าวได้ถูกบังคับใช้จริงแล้วในวันที่ 1 มิถุนายน ปี 2565 สำหรับบริษัท และหน่วยงานราชการที่ดำเนินการเกี่ยวกับข้อมูลส่วนบุคคลใดๆ เช่น ฐานข้อมูลลูกค้าและพนักงาน

โดยเป็นกฎหมายที่มีความสอดคล้องกับกฎหมายคุ้มครองข้อมูลส่วนบุคคล ของพลเมืองสหภาพยุโรป (GDPR) ซึ่งได้มีผลบังคับใช้ในเดือนพฤษภาคม ปี 2561 และได้มีผลบังคับใช้ใน 28 ประเทศทั่วโลก ซึ่งเป็นการลงโทษบริษัททั่วโลก ที่ทำให้เกิดการจัดการที่ไม่ถูกต้องต่อข้อมูลของพลเมืองในสหภาพยุโรป โดยมีค่าปรับสูงสุด 20,000,000 ยูโร

ในประเทศไทย พรบ.คุ้มครองข้อมูลส่วนบุคคล (PDPA) มีการลงโทษด้วยค่าปรับสูงสุดถึง 5,000,000 บาท และจำคุกไม่เกิน 1 ปี

พรบ.คุ้มครองข้อมูลส่วนบุคคล (PDPA) กำหนดให้มีจัดตั้งเจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคล หรือ Data Protection Officers (DPO)

ควรจะมีความรู้ทางด้านไอที หรือความรู้เกี่ยวกับข้อมูลส่วนบุคคล หรือ ทั้งสองอย่าง ในประเทศไทยมีคนจำนวนมากที่มีความรู้ด้านไอที แต่ในเรื่องของความรู้เกี่ยวกับข้อมูลส่วนบุคคล ยังถือเป็นอะไรที่ใหม่สำหรับพวกเขา
